Crown to appeal Graham James two-year prison sentence

The two-year prison sentence Graham James was handed on March 20 for sexually assaulting ex-NHLer Theoren Fleury and former junior player Todd Holt is being appealed by Crown prosecutors in Manitoba, reports CBC.ca.

The sentence was viewed as overly lenient by many outraged Canadians.

In its appeal, the Crown contends that Judge Catherine Carlson “erred in the approach taken in sentencing,” in part by giving too much weight to the totality principle, which comes into play when there are multiple offenses.

The purpose of the totality principle is to avoid imposing consecutive sentences that, in aggregate, exceed the overall culpability of the offender.
